Introduction

These Terms and Conditions of Use of the STROOM Power Application (“Terms and Conditions”) constitute a valid and legally binding agreement between the user (“You”) and PT CST Solusi Indonesia, a limited liability company duly established under the laws of the Republic of Indonesia (“we”, “us”, or “our”). These Terms and Conditions govern Your access to and use of the STROOM Power application, the website STROOMPower.id, other websites managed by us, and any related content or products provided by us (collectively referred to as the “Application”). These Terms and Conditions also govern the ordering, payment for, and use of services provided through the Application (the “Services”).

We reserve the right to amend or update these Terms and Conditions at any time without prior notice to or approval from You. Any such amendments shall form an integral part of these Terms and Conditions and shall become effective upon being published on the Application. You are responsible for reviewing these Terms and Conditions periodically to stay informed of any updates.

By continuing to access or use the Application and/or the Services, You acknowledge that You have read, understood, and agree to be bound by these Terms and Conditions and all applicable laws and regulations, including any additions, amendments, and specific terms imposed by each Service provider, Provider (as defined below), or Payment Method Provider (as defined below). If You do not agree with any part of these Terms and Conditions, You must immediately cease accessing or using the Application and/or the Services.

Access to the Application and the Services is conditional upon your acceptance of these Terms and Conditions.

The Application functions as a platform that facilitates connections between users and available Service providers located in the user’s vicinity. For this purpose, certain Services may require the activation of location services on your device. If the location feature is disabled, some Services may not function properly or may be unavailable.

Your use of the Services is also subject to our operational policies, which may include, among other things, service coverage areas, applicable pricing and tariffs, additional charges, cancellation rules, service capacity, and conditions related to the handling of goods. These operational policies form an integral part of these Terms and Conditions. In the event of non-compliance with such policies, we reserve the right to take any appropriate measures deemed necessary without prior notification or consent.

The decision to download, access, or continue using the Application and the Services remains entirely at your discretion. You may choose to use the Application, utilize any available Services, or discontinue their use at any time.

STROOM Account

Before accessing or using the Application, you are required to accept these Terms and Conditions as well as the privacy policy available within the Application (“Privacy Policy”). You must also complete the registration process by providing the required information. During registration, you will be asked to provide certain personal details, including your full name, a valid email address, and an active mobile phone number. Upon successful verification, our system will create a personal STROOM Power user account (“Account”) that enables you to access the Application and request Services through it. You may update or modify your personal information at any time through the settings feature available in the Application.

Your Account is intended solely for your personal use and may not be shared, assigned, or transferred to any other person under any circumstances. We reserve the right to decline or cancel any service request if we become aware, or reasonably suspect, that your Account has been used by someone other than you.

You are solely responsible for maintaining the security and confidentiality of your Account information, including but not limited to your registered name, email address, mobile phone number, payment information, selected payment method (“Payment Method”), and any verification codes issued by our system or by a payment service provider. Any activity carried out through your Account will be deemed to have been authorized by you. Accordingly, you assume full responsibility for any risks, losses, or consequences resulting from your failure to safeguard your Account credentials.

If you believe or suspect that your Account has been accessed or used without your authorization, you must notify us immediately. Upon receiving such notification, we may take any measures we consider appropriate to secure the Account and address the unauthorized use.

Payments

Certain Services available through the Application require payment. The applicable fees will be displayed in the Application before you confirm or place an order for the Service. We reserve the right to revise or update the applicable fees at any time in accordance with our operational policies and/or applicable laws and regulations. Additional charges or service fees may also be applied where relevant.

To complete a payment using a selected payment method (“Payment Method”), you must be duly registered with the relevant payment service provider (“Payment Method Provider”) and must use payment credentials that are lawfully issued to you. If you choose to use payment credentials belonging to another individual or entity, you are solely responsible for obtaining the necessary authorization from the relevant party and for any consequences that may arise, including disputes, claims, or losses involving you, the other party, us, the Service provider, the Payment Method Provider, or any other third party.

We reserve the right to decline, suspend, or delay the processing of any payment request submitted through a Payment Method if there are reasonable grounds to believe that the transaction may involve fraud, misuse, violation of these Terms and Conditions, or non-compliance with applicable laws and regulations. This includes, but is not limited to, regulations relating to electronic payment instruments, electronic money, payment transaction processing, anti-money laundering requirements, anti-corruption provisions, and the prevention of terrorism financing, as well as any other suspicious or inappropriate activities, including failure by you to fulfill your obligations under these Terms and Conditions.

Your Responsibility

You shall bear full responsibility for any losses, damages, or claims arising from the use of the Application, the Services, or Payment Methods through your Account, whether such use is carried out by you or by any other person accessing your Account. This includes any use that violates these Terms and Conditions, the Privacy Policy, the policies of Service providers or Payment Method Providers, or any applicable laws and regulations. Such violations may include, but are not limited to, activities related to money laundering, terrorism financing, criminal conduct, fraud, infringement of intellectual property rights, or any other actions that may cause harm to us, the public, Service providers, Payment Method Providers, or other third parties, or that may damage the reputation of our company or any related parties.

You are solely responsible for any decisions made in connection with accessing or using the Application, the Services, or any Payment Method. When using the Services or Payment Methods, you are required to treat all Service providers and Payment Method Providers with courtesy and respect. You must not engage in any conduct that is unlawful, abusive, threatening, or harassing.

Limitations of STROOM Liability

The Application and the Services are provided on an “as-is” and “as-available” basis. We do not make any representations or warranties regarding the reliability, timeliness, quality, suitability, availability, accuracy, completeness, or security of the Application or the Services, nor do we guarantee that they will meet your specific requirements or expectations. This includes, but is not limited to, any Payment Methods made available through the Application, which are the sole responsibility of the respective Payment Method Providers. We shall not be held liable for any loss, damage, or inconvenience resulting from errors, failures, or disruptions caused by Payment Method Providers, or from your failure to comply with these Terms and Conditions or with the terms applicable to Service providers or Payment Method Providers.

Use of the Application may be affected by factors beyond our control, including limitations or disruptions in internet connectivity, electronic communications, or the functionality of your device, network provider, or Payment Method Provider. Such issues may result in delays, service interruptions, or other operational difficulties. We are not responsible for any delay, failure of service delivery, loss, or damage arising from these circumstances.

While we are not obligated to actively monitor your access to or use of the Application, we reserve the right to conduct oversight where necessary to ensure the proper functioning of the Application and compliance with these Terms and Conditions, applicable laws and regulations, court orders, or directives issued by administrative authorities or other relevant government bodies.

STROOM Power and our officers, agents or licensors are not liable for incidental, indirect, consequential, special, punitive, or exemplary damages of any kind, including loss of revenues or profits, loss of business or loss of data, in any way related to the service or for any claim, loss or injury based on errors, omissions, interruptions or other inaccuracies in the Service (including without limitation as a result of breach of any warranty or other term of these Terms and Conditions) even if such damage, claims, losses or injuries were foreseen or foreseeable. Any claim against us shall be limited to the amount you paid, if any, for use of the Service.

“Force Majeure Event” means an event beyond the reasonable control of a party which does not relate to its fault or negligence. Neither you nor we will be responsible for a failure to carry out any obligations under the Terms and Conditions to the extent the failure is directly caused by a Force Majeure Event, as long as the affected party:

  • Promptly notifies the other party that it has occurred and immediately notifies the other party when it has ended; and
  • Takes reasonable steps to prevent, avoid and minimise the effects of the Force Majeure Event.

This Clause however does not apply to any obligations to make payments due by you for any Service.

Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Indonesia.

Any dispute, controversy, or claim arising out of or in connection with the use of the Application or the Services shall be subject to the exclusive jurisdiction of the District Court of South Jakarta.
